These Terms and Conditions of Sale govern all purchases made in store at The Goldmarket. By completing a purchase, you agree to these terms. Please read them carefully before buying.
These terms apply to in-store retail transactions only. If you have any questions before purchasing, please speak to a member of our team.

1. New Goods
1.1 Your Statutory Rights
When you purchase a new item from us, your rights are protected under the Consumer Rights Act 2015. Under this legislation, goods sold by a trader to a consumer must be:
- Of satisfactory quality — free from defects, safe, and of a standard that a reasonable person would consider acceptable given the description, price, and any other relevant circumstances;
- Fit for purpose — suitable for the purpose for which goods of that type are generally supplied, or for any specific purpose you made known to us before purchasing;
- As described — matching any description, sample, or model we provided.
1.2 Short-Term Right to Reject (Within 30 Days)
If a new item is found to be faulty, not as described, or not fit for purpose within 30 days of purchase, you are entitled to a full refund. We will not make a deduction from your refund during this period.
1.3 After 30 Days
If a fault becomes apparent between 30 days and 6 months of purchase, we are entitled to attempt a repair or replacement first. If repair or replacement is not possible, or if the same fault recurs, you may be entitled to a partial or full refund.
After 6 months, the burden of proof shifts to you to demonstrate that the fault was present at the time of purchase. We will assess each case individually and fairly.
1.4 Manufacturer’s Guarantee
Where a manufacturer’s guarantee is provided with a new item, this is in addition to, and does not affect, your statutory rights under the Consumer Rights Act 2015.
1.5 Change of Mind — New Goods
We are pleased to offer an exchange or credit note on new, unworn items in their original condition, returned with proof of purchase within 28 days of purchase. We are under no legal obligation to accept returns for change of mind on in-store purchases. This goodwill policy does not apply to bespoke, personalised, engraved, or specially ordered items, which cannot be returned or exchanged.
2. Pre-Owned, Second-Hand and Vintage Goods
2.1 Nature of Pre-Owned Items
Pre-owned, second-hand, and vintage items are priced to reflect their age, condition, and prior use. These items are not new goods, and the standard expected of them under the Consumer Rights Act 2015 is lower than that applied to new goods. The satisfactory quality standard is assessed by reference to the item’s age, price, description, and any specific condition information provided to you at the point of sale.
2.2 Condition Disclosure
We will draw your attention to any known faults, signs of wear, repairs, alterations, or limitations in an item before you purchase. You are encouraged to examine all pre-owned items carefully before committing to a purchase. Our staff will answer questions and, where practicable, provide further information about an item’s history or condition.
Once a fault, defect, or condition issue has been drawn to your attention, whether verbally or in writing — or is clearly visible upon reasonable inspection, you will not be able to raise a complaint in respect of that specific issue after the sale has been completed.
2.3 Statutory Rights Still Apply
The Consumer Rights Act 2015 applies to all goods sold by us, including pre-owned items. We cannot exclude your statutory rights. However, in the context of pre-owned goods, those rights must be assessed against the realistic expectation of a second-hand item at the price paid.
In practice, this means:
- Pre-owned items are not expected to be in perfect condition.
- Wear consistent with the age and type of item does not constitute a fault.
- A condition described to you and accepted by you at the time of purchase does not give rise to a right of return.
- If an item turns out to be materially different from how it was described, or has a significant undisclosed fault, you retain the right to a remedy.
2.4 No Change of Mind Returns on Pre-Owned Items
Pre-owned items are already sold at a discounted price reflecting their condition and provenance. We do not offer exchange, credit, or refund on pre-owned items purchased in store where you have simply changed your mind. This is standard practice across the second-hand and vintage jewellery trade.
The only exceptions are where an item proves to be materially not as described, or where a significant fault not disclosed at the time of sale becomes apparent.
3. Repairs, Resizing and Alterations
3.1 Work Carried Out by Us
Where we carry out repairs, resizing, or alterations to items, whether purchased from us or brought in from elsewhere, we will provide a clear quotation before commencing work. Estimated timescales are given in good faith but are not contractually binding unless expressly confirmed in writing.
3.2 Pre-Existing Condition
Where work is carried out on a pre-owned or antique item that you bring to us, we will assess and advise you of any known risks or pre-existing vulnerabilities before work begins. We accept no liability for damage arising from a pre-existing condition or inherent weakness in the item unless we failed to identify and disclose it at the time of assessment.
3.3 Uncollected Items
Items left with us for repair or valuation must be collected within [90 days / confirm your preferred period] of notification that the work is complete or that the item is ready for collection. After this period, we reserve the right to take reasonable steps to recover costs or dispose of unclaimed items, subject to applicable law.
4. Valuations
Any valuation provided by The Goldmarket reflects an estimate of value at the date of valuation only and is provided for insurance or informational purposes. It does not constitute an offer to purchase the item at the stated value, nor does it guarantee that an equivalent price will be offered or achievable in the market at any given time.
Valuations are provided in good faith based on available information and our professional assessment. We accept no liability for any financial decision made in reliance on a valuation figure.
5. Proof of Purchase
We recommend that you retain your receipt as proof of purchase. This helps us resolve any queries or process a return more efficiently. We reserve the right to request proof of purchase before processing any refund, exchange, or warranty claim.
6. How to Make a Complaint or Return
If you believe you have grounds for a return, refund, or complaint under these terms, please:
- Bring the item to us in store along with your proof of purchase.
- Speak to a member of our team, who will assess the matter and aim to resolve it with you on the day wherever possible.
- If a resolution cannot be agreed in store, we will respond formally within [5 working days / confirm].
Where we agree a refund is due, this will be processed by the same payment method used at the time of purchase, without undue delay, and within 14 days of agreement.
7. Limitation of Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded or limited.
To the fullest extent permitted by law, our liability for any claim arising from a purchase made in store will not exceed the price paid for the item in question.
We reserve the right to decline a return or refund where there is no legal entitlement to one, for example, where a customer has simply changed their mind on an in-store purchase, or where a fault was clearly disclosed at the time of sale. Where a valid statutory right to a remedy exists under the Consumer Rights Act 2015, we will honour it.
8. Governing Law
These terms are governed by and construed in accordance with the law of England and Wales. Any dispute arising in connection with a purchase made at The Goldmarket shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Your Statutory Rights Are Not Affected
Nothing in these terms and conditions is intended to limit or exclude any rights you have as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Protection from Unfair Trading Regulations 2008. If any provision of these terms is found to be unlawful, void, or unenforceable, it will be severed and will not affect the validity of the remaining provisions.
